Security Cameras

A common question from property owners is what privacy rights they have when their neighbors have security cameras and the property owner believes the cameras may be recording parts of their property.

Most resources agree that a home security camera is generally legal if it's recording areas of a neighbor's property where someone would not have a reasonable expectation of privacy.

Texas does have a law making invasive visual recording a criminal offense if someone intentionally records the intimate area of another person without their consent in a space that has a reasonable expectation of privacy. Check out our Recording Law guide for additional resources on video surveillance, audio recording, drones and more.

If there are concerns about the placement of a security camera, resources suggest speaking with your neighbor to try and resolve the situation as well as using things like fences, bushes and curtains to help block the view of the camera.
