Federal and state laws protect certain types of money and property from being taken once a judge has ordered a debt be paid in a debt collection lawsuit. The Texas Supreme Court has also taken action to ensure debtors are properly notified about property that could potentially be seized in order to collect on the debt.
Under new rules issued by the Texas Supreme Court in May 2022, a creditor or turnover receiver is now required to provide the debtor with notice when a post-judgment order may result in the freeze or seizure of personal property. This notice must include the Notice of Protected Property Rights, the Instructions for Protected Property Claim Form, and the Protected Property Claim Form approved by the Supreme Court.
