The Fair Housing Act

The federal Fair Housing Act was passed as part of the Civil Rights Act of 1968. This law is in 42 U.S. Code Chapter 45. It prohibits discrimination in the sale, renting, and financing of housing on the basis of: 

  • race;
  • color;
  • national origin;
  • religion;
  • sex (including sexual orientation and gender identity);
  • family status, and
  • disability.

Texas also has its own Fair Housing Act in Texas Property Code Chapter 301.

The Texas Workforce Commission and the U.S. Department of Housing & Urban Development (HUD) are tasked with taking complaints and enforcing these laws. If you believe that you have been discriminated against, you can file a complaint with one of these agencies.
